How important is planning for your long-term care?
Paraphrasing Judge Learned Hand, a former US Court of Appeals Judge regarding how, as US citizens, we can engage in lawful income tax planning and applying his legal opinion to lawful long-term care planning.
Anyone may arrange his affairs to protect and preserve his assets so that his long term-care costs will be as low as possible; he is not bound to choose that pattern which best pays the nursing home. There is not even a patriotic duty to increase one’s payment to the nursing home.
There is nothing sinister in arranging your affairs as to protect your assets from a nursing home.Everyone does it, rich and poor alike and all do right, for nobody owes any public duty to pay more for a nursing home than the law demands.
